E-DISCOVERY SUPPORT

Electronic discovery (also e-discovery or ediscovery) refers to discovery in legal proceedings such as litigation, government investigations, or Freedom Of Information requests, where the information sought is in electronic discovery.  Electronic discovery is subject to rules of civil procedure and agreed-upon processes.  It often involves review for privilege and relevance before data is turned over to the requesting party.  Because of this, electronic discovery/eDiscovery has become of a vital and important service to a variety of industries.

Technologies and processes involved with eDiscovery are very often complex because of the sheer volume of electronic data produced and stored.  Unlike “hardcopy” evidence, electronic documents are more dynamic and often contain metadata such as time-date stamps, author and recipient information, and file properties. Preserving the original content and metadata for electronically stored information is required in order to eliminate claims of spoliation or tampering with evidence later in the litigation.

With the soaring and unprecedented use of technology in our lives eDiscovery is becoming more and more prevalent.  eDiscovery focuses on the most utilized forms of electronic information used in abundantly in our business and private lives.  Electronic formats include emails, text messages, metadata, website searches, and more.  Because the average lawyer is far from a specialist in information technology.  Therefore the tasks involved in finding, producing, and exchanging e-discovery information is increasingly hired out to firms such as SFI that provide eDiscovery services.   Not only is this eDiscovery a more economical alternative than charging clients a lawyer’s hourly rate for this work, but it is also a practical requirement in order to fully gather the information that the rules of civil and criminal procedure and rules of evidence require be exchanged between the litigants.

As former financial crime investigators, we are acutely aware of the importance of  the handling and use of evidence.   So assisting with proper processing and handling of electronic evidence is something we have experience and expertise in doing.
